PREAMBLE
These General Terms and Conditions of Sale govern the relationship between CAROLINE NAJMAN, a simplified joint-stock company with a share capital of €2,000, headquartered at 109 Boulevard Beaumarchais – 75003 – PARIS, registered with the Nanterre Trade and Companies Register under number 512 547 118 (hereinafter referred to as "CAROLINE NAJMAN"), and customers wishing to make a purchase on the website www.carolinenajman.com (hereinafter referred to as "the customer").
ORDER
Any order implies full and unreserved acceptance of these General Terms and Conditions of Sale. Orders will only be processed after payment is accepted. CAROLINE NAJMAN agrees to honor orders received within the limits of available stock and, in the event of unavailability, to inform the customer by any means of their choice. The customer may then cancel the order and, if applicable, be refunded for amounts already paid.
CAROLINE NAJMAN reserves the right to cancel or refuse any order from a customer with whom there is an ongoing dispute concerning the payment of a prior order.
DELIVERY
Each piece of jewellery is sent in its individual pouch or box. Customers may purchase a gift pouch for €2.50 incl. VAT.
Orders are shipped via Chrono 2Shop to a pick-up point, Colissimo or Chronopost home delivery depending on the destination. Free shipping to metropolitan France on orders over €80.
Caroline Najman will make every effort to ship each order within an average of 72 hours, and no later than 15 business days. For deliveries to countries outside the European Union, any applicable import duties and taxes are entirely the responsibility of the recipient.
If, one (1) month after the indicative delivery date, the product has not been delivered for any reason other than force majeure, the sale may be terminated at the request of either party. The buyer may then recover the deposit, excluding any compensation or damages.
Circumstances considered as force majeure relieving the seller from the obligation to deliver include: war, riots, fire, strikes, accidents, and the inability to procure supplies. The seller will inform the buyer promptly of the aforementioned events or circumstances.
In any case, timely delivery can only occur if the buyer has fulfilled their obligations to the seller, regardless of the cause.
RISKS
Products are deliverable to the address provided by the buyer during the order process. The risk of loss or damage to goods is transferred to the consumer when they or a designated third party, other than the carrier, take physical possession of the goods (Article L138-4 of the French Consumer Code).
PRICES
Prices are indicated in euros, including all taxes, excluding shipping costs, which are the responsibility of the customer. Any changes to the legal VAT rate will automatically affect product prices from the date of implementation.
Shipping fees are charged once per order and can be combined for multiple orders placed during the same sale and on the same credit card transaction. For certain items, additional shipping costs may apply, as specified in the sales offer.
PAYMENT TERMS
Payment in full must be made at the time of the order. Amounts paid can never be considered deposits or down payments. Customers may pay via credit card or PayPal.
For credit card transactions, customers must provide the card number, expiration date, and the three-digit security code on the back of the card. By providing this information, the customer authorizes CAROLINE NAJMAN to debit the account for the total amount of the order. Cash-on-delivery payments are not accepted.
CAROLINE NAJMAN retains ownership of the item until full payment is received. Purchases are made securely. CAROLINE NAJMAN uses 100% secure payment solutions. Payments by credit card (Carte Bleue, Visa, and e-Carte Bleue) are secured by Crédit Lyonnais' Sherlock system. The company also uses the PayPal payment system, which allows account holders to make purchases on the site.
These solutions protect the information customers share with CAROLINE NAJMAN and ensure the security of every transaction.
To combat fraud, CAROLINE NAJMAN has implemented measures that may include:
- Requesting specific documents after payment if an alert is triggered by the order details.
- Blocking an order if the customer account has been previously used for fraudulent activity.
INTELLECTUAL PROPERTY
All texts, comments, photos, trademarks, illustrations, and images reproduced on the website www.carolinenajman.com are protected by intellectual property laws worldwide. Any full or partial reproduction of the website www.carolinenajman.com is strictly prohibited.
SELLER’S RESPONSIBILITY – WARRANTY
The legal compliance warranty covering manufacturing and material defects under normal usage conditions is valid for 2 years.
WARRANTY COVERAGE
Our warranty only covers manufacturing defects and technical issues. Jewelry subjected to improper use or handling, failure to follow care instructions, external interventions resulting in modifications or alterations to the original model, are not covered by the warranty.
The warranty will apply provided the jewelry is used appropriately and care instructions are followed. At our discretion, the jewelry may be repaired, replaced, or exchanged for an identical piece.
MY JEWELRY IS OXIDIZING
Oxidation is a natural phenomenon that can be accentuated depending on skin acidity and usage. This process accelerates when metal comes into contact with agents such as perfume, sea air, sulfur, skincare creams, hairspray, chlorine, and acidic skin pH.
The level of tarnishing (oxidation) depends on the wearer’s skin and jewelry care habits. Tarnishing is therefore not considered a manufacturing defect. We also advise against wearing your jewelry in the bath, during sports activities, or while sleeping.
MY JEWELRY IS DAMAGED BUT IT IS NOT A MANUFACTURING DEFECT
We offer a repair service, subject to a minimum fee of €15 including VAT (see pricing chart). Some requests may incur additional costs depending on the required repairs, subject to the availability of parts and technical solutions.
A quote is issued for each request, and repairs are carried out upon the requester’s approval. Fragile jewelry (e.g., Maya Ring, Serti Ring, Earrings, etc.) must be protected during shipment, using a box or similar.
We are not responsible for jewelry damaged by postal services if not properly packaged. The repair timeline is a maximum of 6 weeks. Payments can be made via check or telephone payment at +33 (0)9 54 53 45 74. Any loss of jewelry will be charged.
Your receipt or proof of purchase serves as a warranty and is essential for repairs.
I LOST MY JEWELRY
We are not responsible for lost jewelry. Replacement of lost jewelry will be charged. You can contact us at serviceclient@carolinenajman.com to inquire about the jewelry’s availability and the procedure to follow.
CAN I LENGTHEN OR SHORTEN MY JEWELRY?
We can lengthen or shorten necklace or bracelet chains upon request. Some ring and earring models can also be custom-made. Please contact us at serviceclient@carolinenajman.com for a quote. Custom-made jewelry is non-refundable and non-exchangeable.
FOR 18K GOLD JEWELRY
Any request for repair, exchange, or resizing of 18K gold jewelry will be handled individually. Please contact us via email for these inquiries at serviceclient@carolinenajman.com.

We offer two payment methods:

HOW TO USE A DISCOUNT CODE?
To use a discount code, enter it in the designated field during checkout. The discount will automatically apply and be deducted from the total amount.
RETURNS
Product features are detailed on www.carolinenajman.com in each product sheet. Customers are fully informed that images, photos, and product colors may not accurately reflect real colors due to browser and screen settings.
- You have 15 days from receiving your order to exchange or return jewelry. This includes the legal 7-day withdrawal period as per Articles L121-20 and following of the Consumer Code.
Items must be returned in their original packaging via tracked mail, unworn, and unused. Items returned incomplete, damaged, used, or soiled cannot be accepted if they are not in resalable condition.
Refunds are issued at the end of the month.
DEFECTIVE ITEM
CAROLINE NAJMAN is liable for product non-compliance and hidden defects under Articles 1641 and 1649 of the Civil Code. Relevant legal articles are detailed in the Terms and Conditions.
PERSONAL DATA
During visits to the site www.carolinenajman.com, CAROLINE NAJMAN may ask its customers for information through questionnaires, forms, and especially during the creation of a customer account. This information is intended for CAROLINE NAJMAN, the data controller, for the purposes of registering and processing orders, managing customer accounts, conducting marketing and statistical studies to provide customers with the most relevant offers, tracking the quality of services, and commercial prospecting. CAROLINE NAJMAN will send commercial offers to customers by email. In accordance with the law of January 6, 1978, the customer has the right to access personal data concerning them, which they can exercise in writing with the Customer Service Department, without prejudice to the right they have to oppose the use of their personal data for commercial solicitations by CAROLINE NAJMAN alone or in partnership with other companies. When creating their account, customers may choose to receive commercial offers sent by CAROLINE NAJMAN's commercial partners.
APPLICABLE LAW AND COMPETENT JURISDICTION
These general terms and conditions of sale are governed by French law. In the event of a dispute, exclusive jurisdiction is assigned to the competent French courts, regardless of the number of defendants and/or counterclaims, even in emergency proceedings or conservatory measures in summary proceedings or by petition.
REPRODUCTION OF ARTICLES L217-4 L217-5 AND L217-12 OF THE CONSUMER CODE
Article L217-4: The seller is obligated to deliver a product in conformity with the contract and is responsible for defects in conformity that exist at the time of delivery. The seller is also responsible for defects in conformity arising from packaging, assembly instructions, or installation when the seller is responsible for these tasks under the contract.
Article L217-5: To be in conformity with the contract, the product must:
1º Be fit for the usual use expected of a similar product and, if applicable:
– Correspond to the description given by the seller and have the qualities presented to the buyer in the form of a sample or model;
– Present the qualities that a buyer can legitimately expect based on public statements made by the seller, the manufacturer, or their representative, notably in advertising or labeling;
2º Or present characteristics defined by mutual agreement between the parties or be suitable for a special use sought by the buyer, made known to the seller and accepted by the seller.
Article L217-12: Action arising from the defect of conformity is prescribed within two years from the delivery of the product.
REPRODUCTION OF ARTICLES 1641 AND 1648 AL 1 OF THE CIVIL CODE
Article 1641: The seller is liable for hidden defects of the item sold that render it unfit for its intended use or that diminish its use to such an extent that the buyer would not have purchased it, or would have paid a lesser price, had they known of these defects.
Article 1648: Action arising from hidden defects must be initiated by the buyer within two years of discovering the defect.
Terms and Conditions of Sale: Caroline Najman Gift Card
Presentation
The Caroline Najman Gift Card is a voucher with a unit value of 50€, 55€, 60€, 65€, 70€, 80€, 90€, 100€, 110€, 120€, 130€, 140€, 150€, 200€, or 300€, usable in Caroline Najman stores or online at our website carolinenajman.com.
Gift cards can be used to pay for jewelry both online and in stores and are also applicable for permanent bracelet services in-store.
Conditions of Use
The Caroline Najman Gift Card is valid for 12 months from its issue date and cannot be renewed.
Exclusions:
The Gift Card is for the sole beneficiary and cannot be resold. It is non-refundable in case of loss or theft. It is possible to use the Gift Card for an amount higher than the value stated on it. The beneficiary must pay the difference directly in-store or online at carolinenajman.com.
The Gift Card is non-divisible: it can only be used in Caroline Najman stores and online at carolinenajman.com. If not used entirely, it cannot be refunded partially.
If a health issue prevented you from using your gift card on time, you are not liable for the administrative fees (subject to presenting a medical certificate) and must send your request directly to communication@carolinenajman.com.
